Terms of Service
Important Medical Disclaimer: PulsER is a CPR training and performance monitoring tool. It is not a medical device, does not provide clinical diagnoses, and is not a substitute for certified CPR training, professional medical judgement, or emergency services. In a real emergency, always call your local emergency number immediately.
1. Acceptance of Terms
By downloading, installing, or using the PulsER application ("App") or accessing any PulsER services (collectively, "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Simmersive Unlimited Pvt Limited ("Company", "we", "us", "our"), operated under the direction of Dr. Rajkumar Elanjeran and Dr. Anitha Ramkumar.
2. Eligibility
You must be at least 18 years of age to use PulsER. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. If you are using PulsER on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Description of Service
PulsER is a mobile application for iOS and Android that, when paired with a PulsER Bluetooth Low Energy (BLE) sensor, measures and displays CPR performance metrics including compression rate (BPM), depth, and chest compression fraction (CCF). The Service includes:
- Real-time CPR metric display during training and simulation sessions.
- Session history recording and review.
- Over-the-air (OTA) firmware updates for the PulsER sensor.
- Performance analytics for training improvement.
4. Medical Disclaimer and Limitation of Use
PulsER is intended exclusively for training, simulation, and performance review purposes. The following restrictions apply:
- PulsER is not a certified medical device under any regulatory framework (FDA, CE, TGA, or equivalent).
- PulsER data must not be used to make clinical decisions or inform patient care in any live emergency or clinical setting.
- PulsER does not replace certified CPR training from an accredited provider (e.g., AHA, Red Cross, Resuscitation Council).
- Metric values displayed (BPM, depth, CCF) are indicative and subject to sensor accuracy limitations — they should not be interpreted as clinically validated measurements.
The Company expressly disclaims all liability for any harm, injury, or adverse outcome resulting from reliance on PulsER data in any real-world emergency or clinical scenario.
5. User Accounts
You may create an account using Google Sign-In. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Notifying us immediately of any unauthorised use of your account.
You may not create accounts on behalf of another person without their consent, or use the Service for any purpose that violates applicable law.
6. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble the App or PulsER firmware.
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Transmit any malicious code, viruses, or disruptive data to the Service.
- Misrepresent PulsER as a certified medical device or use it in any manner that could endanger life.
- Resell, sublicense, or redistribute the App without prior written consent from the Company.
7. Intellectual Property
The Service, including the App, firmware, website, software, design, text, graphics, and all other content, is owned by Simmersive Unlimited Pvt Limited and is protected by applicable copyright, trademark, patent, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal device for your personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any metrics or data produced by the Service.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:
- Personal injury or death resulting from use or misuse of the Service.
- Loss of data or session records.
- Reliance on metric data in a clinical or emergency setting.
- Device damage, including the PulsER sensor or your mobile device.
In jurisdictions that do not allow exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any claim that your use of the Service caused harm to a third party.
12. Modifications to the Service and Terms
We reserve the right to modify or discontinue the Service (or any part of it) at any time with or without notice. We may also revise these Terms from time to time. The updated Terms will be posted at this URL with a new "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, if we believe you have violated these Terms or applicable law. You may terminate your account at any time by deleting the App and contacting us to request account deletion.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
